Do you need a license to sell on Instagram in the UAE?

Instagram has no license of its own. The licensing rule comes from UAE law, and the platform you sell on does not change it. The UAE government states that the e-commerce law, Federal Decree by Law No. 14 of 2023 on Modern Technology-Based Trade, covers buying and selling of goods, services and data online through websites, mobile applications, social media platforms and digital marketplaces. To sell online you must have legal capacity to do business and obtain the licenses and approvals from the relevant authority.

Dubai DET goes further: it says commercial activities are regulated across actual storefronts and e-commerce or social channel establishments, and businesses must hold valid licenses.

Dubai describes the eTrader as a home-based license "specifically tailored for individuals selling products or services through social media and online platforms", issued only as a sole proprietorship with the owner fully liable. The UAE government adds that some emirates issue a standalone individual e-commerce license, while others issue a regular commercial license with an e-commerce activity, and that every e-commerce license needs approval from the Telecommunications and Digital Government Regulatory Authority (TDRA). Do you need the advertiser permit as well?

It may. The advertiser permit is now a National Media Authority (NMA) service. The NMA says the permit allows individuals to publish advertising and media content through their social media accounts, websites or other digital platforms, whether paid or free of charge. As of October 2026 the NMA lists the fee as free for the first three years and AED 1,000 after that, with a service time of three working days, and lists a commercial license among the documents required.

What the NMA service page does not say is whether you need the permit to promote your own products from your own account. An earlier UAE Media Council advertiser guide listed an exception for people advertising their own product, service or company through their personal account, but that guide is no longer online and the NMA page we opened does not repeat the exception. So:

  • You promote your own products from your own account. Ask the NMA in writing whether you need the permit. Do not rely on blog posts that say you are exempt.
  • You post paid promotions for other brands. That is the case the permit is designed for. Read advertiser permit in the UAE.
  • You run a shop account for someone else. Treat it as advertising for a third party and ask the NMA.

For visitors there is a separate permit: the NMA says it is temporary for three months, may be extended up to a total of six months, requires the applicant to be at least 18, is applied for through a licensed UAE advertising agency, and costs AED 500. The NMA pages we opened do not list fine amounts, so ignore fine figures quoted by blogs and ask the NMA directly.

How do you set up an Instagram business legally, step by step?

  1. Decide your structure. Home-based single owner in Dubai: eTrader. Partners, staff or a warehouse: a company license. See the cost guide.
  2. Apply for the license on your emirate's portal. In Dubai, the eTrader is issued within five minutes once your trade name and ID are in order.
  3. Add the license number to your profile and your invoices. The UAE government says online sellers must issue a clear digital invoice for every transaction.
  4. Get product approvals if you sell cosmetics, food, supplements or other regulated goods. The government says you must obtain approvals for regulated or restricted products.

  6. Check VAT. Mandatory registration starts at AED 375,000 of taxable supplies and imports, and voluntary registration at AED 187,500.

Often, but check the activity. Amazon.ae says you need a valid commercial license in the UAE, mainland or free zone. noon requires a valid trade license including Sales, Trading, Manufacturing or Distribution/Wholesale, and its Individual Seller category exists in Egypt only. So an Instagram-only seller who wants to list on noon needs a license with a selling activity, not just a social media presence.
